무기체계 구매 재입찰공고
국가를 당사자로 하는 계약에 관한 법률(이하 “국가계약법”이라 한다.) 제8조(입찰공고) 및 방위사업청 훈령 제379호 방위사업관리규정 제213조(무기체계 구매 입찰공고)에 의거 무기체계 획득계획을 다음과 같이 공고합니다.

▣ 사 업 명 : JTAC용 표적영상수신기사업
▣ 사업개요 : 대한민국 군에서 사용하는 JTAC용 표적영상수신기를 확보하는 사업
▣ 입찰 참가자격
❍ 국가를 당사자로 하는 계약에 관한 법률(이하 “국가계약법”) 시행령 제12조의 요건을 갖춘 자.
❍ 국가계약법 제27조 및 동 시행령 제76조, 방위사업법 제59조 및 동 시행령 제70조의 규정에 의한 입찰참가자격제한처분을 받지 아니한 자.
❍ 제안요청서(RFP)가 요구하는 무기체계를 생산할 수 있는 해외업체
▣ 사업설명회 참가대상
❍ JTAC용 표적영상수신기를 생산할 수 있는 해외업체(해당업체의 국내지사 포함)
※ 군수품무역대리업체를 활용은 제안업체의 “군수품무역대리업체 활용요청서” 제출 후(제안서 제출시 제출) 방위사업청의 승인 후 가능함.
▣ 사업설명회
❍ 일시 / 장소 : 2017 2. 3(금) 14:00 / 방위사업청 입찰실
※ 업체 인원 : 13:30까지 과천정부종합청사 고객안내센터로 집결
❍ 참가신청 : 2017. 1. 20(금) 16:00 까지
1) 사업설명회 참가자는 참가신청접수를 위해 참가신청 일시까지 업체명/직책/성명/국적/생년월일(여권번호)/전화번호(핸드폰번호)를 작성하여 E-mail 또는 FAX로 방위사업청(공중지휘통제감시사업팀) 담당자에게 제출해야 합니다.
❍ 설명내용 : 제안요청서 세부내용(제안서작성, 평가방법/기준) 등
1) 사업설명회시 제안요청서를 배부하며, 사업설명회에 참석하지 않은 업체는 사업에 참여할 수 없습니다.
2) 사업설명회 참가는 보안심사위원회를(참가신청 접수 후 추진) 거쳐 방위사업청장으로부터 사업설명회 참가 승인을 통보받은 업체에 한합니다.
* 사업설명회 참가시 신분증 및 재직증명서 지참 필요
▣ 계약 및 기종결정 방법
❍ 구매방법 : 국외구매
❍ 계약형태 : 일반경쟁(협상에의한계약)
❍ 기종결정
1) 입찰참가 자격이 있는 자가 제출한 제안서를 평가하여 시험평가 대상장비를 선정하고, 대상장비로 선정된 기종에 대해 협상 및 시험평가를 실시합니다.
2) 모든 협상 및 시험평가 완료 후『요구조건 충족시 최저비용에 의한 방법』으로 기종을 결정합니다.

▣ 제안서 접수(입찰등록 마감)
❍ 제출기한 : 2017. 2. 21(화) 15:00시 까지
❍ 제출장소 : 방위사업청 공중지휘통제감시사업팀(담당자:주무관 최준영)
❍ 제출방법 : 직접제출(우편접수 불가)
❍ 구비서류 : 제안서와 동시에 제출되어야 할 서류
1) 국외조달원 등록증 사본 1부
2) 제작자 증명서 원본(공증필) 1부
3) 공급자 증명서 원본(공증필) 1부
4) 제안업체 명의 입찰보증금 납부 관련서류 1부
(“입찰보증금 및 국고귀속에 관한 사항” 참조)
5) 신용조사평가업체(NICE DUNS & BRADSTEET)에 평가 요청한 신용도 평가 증빙자료.
6) 군수품무역대리업체 미활용 확인서 1부
※ 제안업체는 군수품무역대리업체를 활용하지 않음을 원칙으로 해야 합니다. 단, 직접 참여가 불가피할 시 “군수품무역대리업체 활용요청서” 및 제안업체와 군수품무역대리업체간 체결한 군수품무역대리 계약서 사본 각 1부를 제출하여야 하고 방위사업청은 이를 검토하여 승인여부를 결정 할 것입니다.

9) 국가계약법 시행령 제12조제3항 각 호의 어느 하나에 해당하지 않음을 입증하는 서류(「형의 실효 등에 관한 법률」 제2조제5호에 따른 범죄경력자료의 회보서나 판결문 등). 다만, 입찰참가자가 위 입증서류를 제출하기 어려운 경우에는 위 시행령 제12조제5항에 따라 입찰참가자로부터 위 시행령 제12조제3항 각 호의 어느 하나에 해당하지 아니한다는 사실을 적은 서약서(제안요청서 5부 또는 인터넷 참조)
10) 기타 필요한 서류(자세한 사항은 제안요청서 참조)
▣ 입찰보증금 및 국고귀속에 관한 사항
❍ 입찰참가 자격에 해당하는 자는 제안서 제출 시 관련된 의무의 성실한 이행을 보장하기 위해 총 제안금액의 5% 이상에 해당하는 입찰보증금을 설정하여야 합니다.
❍ 다음 각 호에 해당하지 아니한 자로서 국가계약법 시행령 제37조 제3항 각 호에 해당하는 자는 입찰보증금을 면제받을 수 있으며, 이 경우 국가계약법 시행규칙 제43조 제2항의 규정에 의해 입찰보증금 지급각서를 입찰참가 자격에 해당하는 업체 명의로 제출하여야 합니다.
1) 방위사업청에 입찰보증금 등 국고귀속 조치에 응하지 않고 있는 업체
2) 국가계약법 제27조 및 동법 시행령 제76조의 규정에 의한 입찰참가자격 제한처분을 받은 자로서 그 제재기간이 만료된 날로부터 다시 그 제한 처분기간에 해당하는 기간 중에 있는 업체
3) 입찰참가등록 마감일 현재 당해 사업을 영위한지 1년 미만인 업체
❍ 낙찰자가 소정기일 내에 계약을 체결하지 아니할 경우 국가계약법 제9조 및 동법 시행령 제38조의 규정에 의하여 입찰보증금은 국고에 귀속되며, 동법 제27조 및 동법 시행령 제76조의 규정에 의하여 입찰참가자격 제한처분을 받게 됩니다.
▣ 입찰무효에 관한 사항
❍ 국가계약법 시행령 제39조 제4항과 동법 시행규칙 제44조 및 물품구매(제조) 입찰유의서(기획재정부 계약예규 제290호, ‘16. 1.1.) 제12조에 해당하는 입찰은 무효입니다.
▣ 기타 입찰에 필요한 사항
❍ 본 입찰에 참가하고자 하는 자(업체)는 청렴계약 이행을 위한 청렴서약서를 제출하고, 청렴특수조건을 완전히 숙지한 다음 입찰에참가하여야 하며, 청렴서약서 및 청렴특수조건은 제안요청서 제5부 또는 인터넷(http://www.d2b.go.kr)을 참조하기 바랍니다.
❍ 입찰자는 입찰 관련서류 및 입찰 관련 법령을 숙지한 후 입찰에 참여하여야 하며, 이를 숙지하지 못한 책임은 전적으로 입찰자에게 있습니다.
❍ 본 입찰공고와 관련하여 한글과 영문의 해석이 상충될 경우 한글의 해석과 의미가 우선합니다.

Announcement of Proposed System Acquisition Plan
I am pleased to announce the following weapon system purchase plan in accordance with Article 8 of the Act on Contracts to Which the State is a Party and Article 213 of the Defense Acquisition Program Management Regulation 379.

▣ Project Title : JTAC(Joint Terminal Attack Controller) Target Video Receiver procurement
▣ Project Description : This program is for acquiring JTAC Target Video Receivers which will be used in ROK Armed Forces.
▣ Qualification for Bidding Participation
❍ A participant that is qualified under Article 12 of the Enforcement Decree of the Act on Contracts to Which the State is a Party.
❍ A participant who is not restricted by Article 27 of the Act on Contracts to which the State is a Party and, Article 76 of the foregoing Enforcement Decree, Article 59 of the Defence Acquisition Program Act, and Article 70 of the foregoing Enforcement Decree.
❍ A manufacturer(s) who is capable of providing the weapon system as it is requested in the RFP.
▣ Participants for Explanatory Session
❍ An overseas manufacturer(s), including its branch offices in Korea, who is capable of manufacturing JTAC(Joint Terminal Attack Controller) Target Video Receiver.
※ in case of using Commissioned Agent, approval should be obtained from DAPA after submitting a copy of Request to use Commission Agent.(proposing companies should include a copy of Request to use Commission Agent in the RFP)
▣ Explanatory Session
❍ Date/Location : 3 February, 2017(14:00) / Bidding room, DAPA
※ All participants should arrive at the Customer Service Center of Gwacheon Government Complex by 13:30.
❍ Registration submission dead line : 20 January, 2017(16:00)
1) All participants in the explanatory session are required to submit their company name, position title, name, nationality, date of birth(or passport number), and phone number(or cell phone number) for his/her entrance to DAPA, via FAX or e-mail by the aforementioned date to DAPA(Aerial C4ISR Project Team)
❍ Contents : Detailed information of RFP(evaluation process/standard), etc.
1) RFP will be distributed to the participants at the site, and those who did not participate in the explanatory session may not participate in this program.
2) Participation in the explanatory Session is limited to the companies that are notified of Approval for Explanatory Session Participation from Minister of Defense Acquisition through “Security Evaluation Committee” which will be held after registration submission.

❍ Contract method : Foreign purchase

❍ Source Selection
1) The companies' proposals shall first be evaluated to select the eligible entities. DAPA shall then conduct T&E and negotiations on the selected system(s).
2) once negotiations and T&E are completed, a source(contractor) shall be selected via The Requirement Fulfill with Minimum Costs Technique.

▣ Proposal Submission(Bidding Registration Deadline)
❍ Date : 21 February, 2017 15:00
❍ Location : Aerial C4ISR Project Team of DAPA(Project Manager Choi, Juneyoung)
❍ Submission method : on site submission(No mail)
❍ Required documents : Upon submission of the proposal
1) one copy of Foreign Procurement Registration Certificate issued by DAPA
2) one original copy of Proof of the Manufacturer(notarized)
3) one original copy of Proof of the Supplier(notarized)
4) one copy of bid-bond documents under proposing entity’s name
(Refer to Bid-Bond and Reversion Guideline)
5) evidential documents requesting for assessment of the credit level of the vendor to credit assessment agency(NICE DUNS & BRADSTREET)
6) one copy of Confirmation of Nonuse of Agent(when the manufacturer is directly involved to the bidding)
※ The proposing company is obliged to keep nonuse of the commission agent. But, if not inevitably, you shall submit one copy of request of using commission agent in document and one copy of contract document between the proposing company and the commission agent. And then DAPA will review these documents and decide if these could be approved or not.
7) one original copy of the Pledge of Integrity
8) one original copy of the Special Terms and Conditions for Integrity Pact
9) Documents to prove that it does not apply to each of the regulations stated in Article 12 Clause 3 of the Act on Contract to Which the State is a Party. (Letters or written rulings on criminal records pursuant to Article 2 Clause 5 of the Act on Invalidation of Punishment). However, in case the provision of verification documents is difficult by the bidder, a written pledge(specific form can be found in RFF Part 5 or downloaded at our official website) shall be provided proving that it does not apply to each of the regulations of the aforementioned enforcement decree Article 12 Clause 3 in pursuant of the respective decree

▣ Bid-Bond and Reversion Guideline
❍ Entities qualified for participation shall prepare 5% of the proposed price or more as the bid-bond to guarantee the implementation of its obligation when submitting the proposal.
❍ The proposing entities, which do not applied to the following each provisions but to each provision of Article 37 Clause 3 of the Enforcement Decree of the Act on Contracts to Which the State is a Party, may be exempted from the bid-bond requirement. When exempt, the qualified proposing entity shall submit a Memorandum of Payment for Bid-Bond under the name of the proposing entity pursuant to Paragraph 4, Article 37 of Enforcement Decree of the Act on Contracts to Which the State is a Party.
1) An entity who has not yet made a payment due for reversion to DAPA
2) An entity who is currently prohibited from entering into an agreement with DAPA under Article 27 of the Act on Contracts to Which the State is a Party, and Article 76 of the foregoing Enforcement Decree.
3) An entity who was formed less than one(1) year from the date of registration deadline
❍ If the successful bidder fails to conclude the contract by the appointed date, the Bid-Bond shall come under the jurisdiction of the Nation by Article 9 of the Act on Contracts to Which the State is a Party and Article 38 of the foregoing Enforcement Decree, and the successful bidder's application shall be restricted for some period by Article 27 of the Act on Contracts to Which the State is a Party and Article 76 of the foregoing Enforcement Decree.
▣ Invalidation of the Bidding
❍ A Bidding which falls under Enforcement Decree of the Act on Contracts to Which the State is a Party Article 39, Paragraph 4 and Enforcement Regulation Article 44, and Commodity Purchase(Manufacturing) Bidders Annexes(Contract Regulation 290, 1 Jan, 2016) Article 12 shall be considered invalid.
▣ Other Bidding Requirements
❍ Bidding participants(company) shall submit an oath of fulfilling a clean contract. The bidder shall have full knowledge of the clean contract special conditions, and the clean contract oath document. The special conditions can be found in RFF Part 5 or downloaded at our official website(http://www.d2b.go.kr)
❍ The bidder shall have full knowledge of bidding documents and Decrees concerned(including foregoing Enforcement Decree), and the bidder shall be responsible for ignorance of such information.
❍ If the interpretation of Korean and English language differs, the interpretation and meaning of Korean language shall have the higher priority.
